Terms of use
Thank you for choosing to use our services at The Bay GP clinic. These terms and conditions set out important information including what you can expect from our private GP services, what we expect from you, and what to do in the event of cancellations, or have a complaint. You are expected to agree to these terms and conditions at the time of booking your appointment.
Please note that we do not offer emergency treatment or walk-in appointments.

1. Who we are:
​We are The Bay GP clinic (“we”, “us”, “our”), a private clinic led by General practitioners, based at Spencer Private Hospitals, Margate, Kent. You can contact us by emailing info@thebaygp.com, or calling Spencer Private hospital on 0330 019 4890.

2. Our services:
2.1 Private GP services are provided on a 'pay as you go' basis at The Bay GP clinic. These include GP consultations, health screening and wellbeing services, as set out on The Bay GP website.
​​2.2 We reserve the right to change the type of services provided, location in which they are provided, and the cost of services at any time.

3. Booking an appointment
3.1 You can book an appointment through the booking link on our website and select the date and time of your choosing. Upon booking, you will need to provide some personal information, accept the terms and conditions and complete the check-out process. Payment will be taken at the time of booking by our third-party provider.
3.2 Upon arrival at the clinic, our team will carry out verification by checking your ID documents. Please bring with you an official photographic ID such as your passport or driving license. We cannot carry out your consultation without the ID verification.​

4. Your consultation
4.1 All our doctors are registered with the General Medical Council, and will carry out your consultation in line with UK regulations and procedures. ​
4.2 You are expected to provide accurate information relating to your medical history and symptoms, and bring any relevant hospital letters or prescriptions with you. Please be aware that the doctors do not have access to your NHS records. Our doctors may ask you to provide a copy of your NHS GP summary before completing reports or medicals.
4.3 Any private prescriptions, referrals for tests or to see a specialist will be provided if deemed clinically necessary by the doctor, and will be discussed with you during your consultation. There will be fees for lab tests and some of our services. Please read the FAQ section carefully regarding services that can and cannot be provided at The Bay GP clinic.​
4.4 Please note that we do not provide prescriptions for any controlled drugs, sleeping tablets, or medications under 'shared agreement' with NHS hospital and GP providers. Please see the following link for a list of controlled drugs.

5. Charges and cancellation fees
5.1 Pre-payment will be taken for the appointment at the time of booking. Any further tests that may be needed at the time of consultation will be fully discussed with you during the consultation, and laboratory tests such as blood tests or urine test will incur an additional charge. Payment for this will be taken at the end of the consultation.
5.2.1 You may cancel and/ or change your booking by clicking the link in your confirmation email at any time up to 24 hours prior to the appointment and will receive a refund.
5.2.2 If cancelling within 24 hours, 50% of the cost of the appointment will be charged, the other 50% will be refunded to your card within 5-7 business days. Please contact info@thebaygp.com if you have not received your refund after this date.

6. Our responsibilities
6.1 Our team will provide medical services, including consultations, examinations, treatments, and other necessary healthcare services, in accordance with professional standards and best practices in the UK.
6.2 The clinic cannot provide appointments with doctors whom the patient is registered with on the NHS.
6.3 Our team will make all efforts to safeguard the personal and medical information of clients from unauthorised access or disclosure. Please refer to our privacy policy for further details.
6.4 We will make all reasonable efforts to keep the information on the website accurate and up to date. The content on the website is not intended for medical advice, and must not be substitute for a health provider’s assessment and treatment.
6.5 We will make all reasonable efforts to provide a continued service, but from time to time, our services may have to cease due to disruptions due to factors outside of our control, such as but not limited to system malfunctions, strike, fire, closure of premises.
6.6 We are not responsible for delays outside of our control; in the event of a delay that occurs in supplying our services, we will contact you as soon as possible to let you know, and take reasonable steps to minimise the delay.
6.7 On occasion, we may have to suspend the supply of all or part of our services to; (a) deal with technical problems or make technical changes, or (b) update our processes and services to comply with relevant laws and regulations.
6.8 We will be transparent and share our fees with you before carrying out consultations, medicals, tests, or completing forms. Our fees will be advertised on our website https://www.thebaygp.com/

7. Your responsibilities
7.1 You are responsible for providing accurate and up to date contact details and information relating to your symptoms and consultation. This is of paramount importance to allow the doctor to make an accurate diagnosis and provide appropriate advice and treatment.
7.2 You are responsible for providing our team with valid identification documents when requested. You acknowledge and accept that we have no liability for any injury, damage, loss or other detriment as a result of you not providing this information.
7.3.1 You agree to maintain open and respectful communication regarding healthcare concerns, treatment options, and other relevant matters, and abide by our zero tolerance policy.
7.3.2 You agree to share information from your NHS GP medical record if requested by our doctors.
7.4 We reserve the right to terminate the consultation and prevent further bookings at the clinic in the event of abusive or inappropriate behaviour towards any member of staff.
7.5 We reserve the right to terminate your access to our services, effective immediately if you are in breach of these terms and conditions.
7.6 You agree to comply with our website terms and conditions, and not misuse the website, attempt to gain unauthorised access to our website or the server on which it is stored. Please see our website T&C for further information.

8. Complaints
8.1 If you have any complaints about the services that we provide or a dispute regarding these T&Cs then please contact us at info@thebaygp.com to discuss your concern in the first instance. If this is not resolved, you can submit your complaint to the medical director of Spencer private hospital, Margate.

The personal information that we collect very much depends on the relationship you have with us. From Patients to Staff, to Family, Friends and Relatives, Contractors and Visitors to our sites, we will collect different information about you.

When doing so we must comply with the UK General Data Protection Regulation, and other such laws to protect your information.

We may collect “personal data” such as name, address and telephone number or in some cases more detailed and specialised data defined as “special category data” such as healthcare records, race, sex or at times criminal conviction details about you. For example, as a patient it will be necessary to collect information about your health and previous care.
Personal Information will be collected on completion of a Registration Form as part of this document you will also be provided with the options available for us to communicate with you. If you provide personal information to us about other individuals such as Next of Kin, financial or medical information, you must advise them of you doing so and ensure that they are provided with access to our Privacy Notice detailing how we will process their information.

We may collect your data from several different sources, such as GPs, Dentists, Other hospitals, NHS and Private Providers, Mental Health Providers and Clinicians (including their Medical Secretaries). There may also be occasions when we need to obtain information directly from you or another organisation on your behalf.

We could obtain information from other healthcare organisations in the following forms such as Medical records from your GP, Clinicians, Medical Secretaries, Dentist and NHS or any private healthcare organisations.

Calls to our 0330 019 4890 telephone number may be answered by our external telephony answering service. The information collected from you will be the minimum needed to either answer or redirect your call. The information you volunteer to us will be used for the purpose of responding to you or to improve the call answering service we provide. Please do not volunteer any medical or other sensitive information to the answering agent.

It may be necessary for us to seek information and share information with other organisations such as third parties. More often this could be in the form of Insurance Companies, Government bodies and Healthcare Organisations.

At The Bay GP we are most likely to contact you by letter, telephone, email and SMS text message service.
When contacting you in these ways, we will be doing so based on the information you or a third party has supplied to us and your preferences for us doing so.

How do we process information about you?

We will process your information for several reasons; however we will let you know why we are processing it and the legal basis we have for doing so.
Below sets out in more detail the common legal basis that will be used to justify the processing of your personal data, and in addition the most common ones for processing of special category data.

Consent – We will use consent for some if not all the information we process about you. This will be done via the patient registration document that you read and sign when you book an appointment with us. You will be asked to give clear consent for us to process the personal data and for a specific purpose. By doing this you are entering into a contract with The Bay GP Clinic, to provide you with healthcare services.

Contract – By entering a contract with us, you will provide us with the necessary legal basis to process your information under contractual grounds. Often for the purposes of providing you with healthcare, based on a contract between you and Spencer or one of its Clinicians.

Legal obligation – In short, when you are obliged to process the personal data to comply with the law.

Vital interests – We would use this basis when it is absolutely necessary to do so and in the interests of protecting someone’s life. We will only do this when it is not possible to obtain consent direct from the patient.

Public task - The processing is necessary for us to perform a task in the public interest . This is unusual in relation to the provision of your care, however if required to process your information in the public interest, we would do so in accordance with this privacy notice.
Legitimate interests - We will use this basis for processing of your personal information. We will only process if we have an appropriate business need to and that in doing so the business need does not cause harm to you. In the main we will rely on this basis to process for activities such as maintaining our records, developing and improving the business and quality assurance.

The Right To Be Informed:
You, the individual have the right to be advised what personal information we hold, why we process it, how we store it and where we share it.
The Right To Access Your Information:

Depending on the grounds under which the request has been submitted and in relation to the type of information we hold, It is possible that the request can be refused should the information held be required in the public interest, including public health or for the purposes of defending against legal claims.
The Right To Restrict Processing:
You have the right to restrict processing of your personal information. You can limit the use of your personal information, amend your preferences and communication means at any time.
The Right To Data Portability:
You have the right to request your data be portable and in an accessible format, You can also request us to pass your information to other organisations in a similar common format.
The Right To Object:
You have the right to object to our use of your personal data, in these circumstances we will need to work with you to establish if this is applicable to all data we hold or certain aspects of it.
Your Right To opt Out Of Automatic Decision Making And Profiling: From time to time we may use computer generated software to analyse data and activity across our business. This service automatically monitors and records your information and uses it to guide us on marketing drives, customer preference and areas of interest.
